This privacy statement applies to the processing of personal data by MF Shipping Group (statutory name: MF Beheer B.V.), Chamber of Commerce reg. no. 02073715, as well as all companies belonging to MF Shipping Group, to be referred to below as MFSG.

Processing of personal data by MFSG

MFSG considers the protection of personal data to be highly important. MFSG respects your privacy, and ensures that your personal data are always processed confidentially and in accordance with applicable data protection legislation.

Purpose of processing personal data

MFSG processes your personal data – mainly- for the following purposes:

  1. The implementation of agreement(s) entered into with you.
  2. Operating our office administration as well as other internal management operations.
  3. Calculating, recording and collecting payable amounts, including placing receivables with third parties for debt collection.
  4. To get in touch with you and to respond to questions asked by you.
  5. To keep you informed of new services offered by MFSG.
  6. Handling your request for information.
  7. Sending electronic information that reaches you by email.
  8. For compliance with legal requirements such as record-keeping and archival obligations.
  9. ​Enabling dispute settlement and audits to be conducted.

​Legal basis for processing

  • The legal basis for the processing lies in at least one of the following elements:
  • Your consent (Article 6(1)(a) GDPR).
  • Taking pre-contractual steps at your request and/or implementing the contract concluded with you (Article 6(1)(b) GDPR).
  • Compliance with legal obligations (Article 6(1)(c) GDPR).
  • Protecting your vital interests and those of others (Article 6(1)(d) GDPR).
  • Carrying out a task in the public interest or in the exercise of official authority (Article 6(1)(e) GDPR).
  • Processing is necessary for the purposes of the legitimate interests (Article 6(1)(f) GDPR).

Sharing personal data with third parties

MFSG will not share your personal data with third parties without your consent unless it is necessary for the performance of the contract or to comply with a legal obligation. When providing your personal data to third parties, it will be agreed beforehand that they will comply with the requirements for processing personal data under the GDPR.

Retention period

MSFG will retain your personal data in accordance with the GDPR and specific retention periods under imperative law. The data will not be retained for a longer period than strictly necessary to achieve the objectives for which the data were collected.

Security of personal data

MFSG takes all appropriate technical and organisational measures to protect personal data from loss or any form of unlawful processing.

Your rights

You have several rights under the GDPR. Those rights include the following:

Right of access

You have the right to access the personal data processed by MFSG.

Right to rectification, completion or erasure (the right to be forgotten)

You have the right to have data changed, completed or even erased if those data are not (or no longer) correct or if their processing is not (or no longer) legitimate.

Right to object

The right to object means that you are entitled to object to certain forms of processing of your personal data in light of your specific situation. You have this right for all processing operations that are not based on (1) your consent, (2) the taking of pre-contractual steps at your request and/or the performance of the contract concluded with you, (3) compliance with legal obligations or (4) protecting your vital interests or those of others.

If you object to other forms of processing of your personal data, then we will without delay, but within one month, assess whether we are able to comply with your objection. In that case it is for MFSG to demonstrate that despite your objection, we still have a legitimate interest in continuing to process your personal data. If you prevail in that relative assessment of interests, we will cease the processing of those data.

Right to data portability

You have the right to receive (back) the data provided by you to MFSG in a customary file format. This right applies only to those of your personal data that we process based on your consent or a contract concluded with you. Furthermore, this right applies only to those data that we are already processing in electronic form (i.e. not to analogue processing operations). You are free to then pass such data on to a third party.

If there is a connection between our systems and the systems of a third party to which you wish to forward the data or have them forward, then we may be able to directly forward the data on your behalf. Please ask us about the available options.

Deadlines

We will normally answer your questions within one month. If answering a question should require more time, we will let you know within one month. Due to the complexity of your request and/or the number of requests received, it is possible for the total response time to be as much as three months in some cases.

Identification

For all requests made to us, we may require further proof of your identity. We do this to avoid disclosing personal data to the wrong parties, or making inappropriate changes to personal data or to the manner in which we process such personal data. To ensure a prompt response to your request, we would therefore like to ask you to attach a copy of your identity document in advance.

Individual assessment of all requests

We point out that the above rights are not absolute rights. There may be circumstances due to which we cannot comply with a particular request. We will always assess every request against the individual background . If we will not (or cannot) comply with your request, then we will of course provide you with a proper explanation of our decision. In those cases, you have the option of involving the courts if you should wish to do so.

Supervisory body

We will of course be pleased to help you if you have any complaints about the processing of your personal data. Under the GDPR, you are also entitled to file a complaint with the Data Protection Authority about our processing of your personal data. You can contact the Data Protection Authority for this purpose.

The website may contain links to other websites. This Privacy Statement applies only to the MFSG website. Other websites may implement their own privacy policies. MFSG recommends that you always read the privacy statements of other websites before you use them.

Changes to the privacy policy

MFSG will make changes to its privacy policy from time to time to keep it up to date. Our website will always carry the latest version of our privacy statement. MFSG therefore recommends that you review our privacy statement regularly. In case of any major change, MFSG will do the utmost to inform you by email and via our website.
